Terms of Service & Disclaimer — Cleaning in Motion Territory Brief

The short version The Territory Brief is a research and prospecting aid built from public information. We work hard to make it useful, but we cannot guarantee it is accurate, complete, current, or that it will win you any business. You use it at your own risk. The most you can recover from us is what you paid us.

1.What this service is

The Cleaning in Motion Territory Brief ("the Service") is a subscription and one-time-purchase research product that compiles recent commercial-real-estate "trigger events" — such as property sales, new openings, leases, permits, construction, hiring signals and public RFPs — into a prioritized list of potential facility-services sales leads (cleaning/janitorial, parking-lot maintenance and landscaping) for a chosen metro area. The Service may also include suggested contact information and outreach guidance.

The Service is an informational and lead-generation tool only. It is not a guarantee of business, a binding representation about any property or person, legal advice, financial advice, or a substitute for your own due diligence.

2.Data accuracy disclaimer

The information in each brief is gathered from third-party and public sources (including county records, government procurement portals, brokerage press releases, news outlets, business directories, mapping data and contact-enrichment providers). These sources are outside our control and may be incomplete, outdated, mis-keyed, or wrong.

We do not warrant or guarantee the accuracy, completeness, reliability, timeliness, or fitness of any lead, address, phone number, email, contact name, square footage, ownership detail, dollar figure, date, or other data point in any brief.
Property details, ownership, tenancy and contact information change frequently and may be out of date by the time you act on them.
Contact information is provided as a research starting point. You are solely responsible for verifying any contact and for ensuring your outreach complies with all applicable laws (see Section 5).
Inclusion of a property, business, or individual in a brief is not an endorsement, and does not imply any relationship between them and Cleaning in Motion.

Verify before you act Always independently confirm any lead, contact, or fact before contacting a prospect, making a bid, signing a contract, or making any business decision. Treat every brief as a lead to be verified — not as verified fact.

3.No guarantee of results

We make no promise or guarantee that the Service will generate leads that convert, appointments, contracts, revenue, or any particular business outcome. Sales results depend on many factors outside our control, including your own outreach, pricing, follow-up, market conditions and timing. Any examples, sample briefs, or figures we show are illustrative only and are not a prediction of your results.

4.Subscriptions, billing & cancellation

Plans. We offer a $20/month recurring subscription and a $15 one-time purchase. Pricing is shown at checkout and may change with notice for future billing periods.
Recurring billing. Monthly subscriptions automatically renew and rebill each month to your payment method until you cancel. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms.
Cancellation. You can cancel a monthly subscription at any time from the Manage / cancel page, which sends you to the Stripe customer portal. Cancellation stops future renewals; it does not retroactively refund the current period.
Refunds. Because the Service delivers digital research immediately, all fees are non-refundable except where required by law or at our sole discretion. A one-time purchase delivers a single brief and does not recur.
Complimentary access. We may issue promo/coupon codes (e.g. for free or discounted access) at our discretion; these may be limited, modified, or withdrawn at any time.

5.Acceptable use & your responsibilities

You agree that you will:

Use the briefs only for your own legitimate business prospecting, and not resell, republish, or redistribute the data to third parties without our written permission.
Comply with all laws that apply to your outreach, including telemarketing, anti-spam (e.g. CAN-SPAM, TCPA), Do-Not-Call, email-consent and data-privacy laws. You — not Cleaning in Motion — are solely responsible for how you contact any lead.
Independently verify any information before relying on it.
Not use the Service for any unlawful, harassing, or deceptive purpose.

6."As is" — no warranties

The Service and all briefs, data, and content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defect will be corrected.

7.Limitation of liability

To the fullest extent permitted by law, in no event will Cleaning in Motion, Motion Ave Inc., or its owners, officers, employees, contractors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost business, lost data, or loss of goodwill, arising out of or related to the Service or any brief, even if advised of the possibility of such damages, and regardless of the legal theory. Our total aggregate liability for any and all claims relating to the Service will not exceed the greater of (a) the total amount you paid us in the three (3) months immediately before the event giving rise to the claim, or (b) twenty U.S. dollars ($20).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the maximum extent permitted by law.

8.Indemnification

You agree to indemnify and hold harmless Cleaning in Motion, Motion Ave Inc., and its owners and personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or any brief, your outreach to leads, or your breach of these terms or any applicable law.

9.Third-party sources & trademarks

Briefs cite and link to third-party public sources. We are not responsible for the content, accuracy, or availability of those sources. Any company names, property names, or trademarks referenced in a brief belong to their respective owners and are used only for identification and reference.

10.Privacy

We collect the information you provide (such as your email and service-area preferences) to deliver the Service, and we use Stripe to process payments. We do not sell your personal information. If you have a privacy request, contact us using the details below.

11.Changes to these terms

We may update these terms from time to time. The "last updated" date above reflects the current version. Continued use of the Service after a change means you accept the updated terms.

12.Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
